tax audit/management liability
At D+C we have identified that many SMEs do not carry Tax Audit and/or Management Liability Insurance. This leaves many businesses open to significant exposure to uninsured risk.
In regards to tax audits, The Age recently noted the Australian Taxation Office (ATO) will commence random audits on SME's and individual taxpayers during 2016. These audits will be conducted to identify the amount of revenue not collected due to tax evasion. It is interesting to note that the ATO confirmed they will not be reviewing high-wealth individuals or companies. The ATO aims to produce a more informed estimate of tax evasion by including the 'income tax gap' next year. There will be particular focus on those associated with over-claimed deductions and the cash economy.
It is evident changes in current legislation has also imposed tougher restrictions and obligations on management teams and directors. Many businesses do not have adequate contingencies in place to deal with the costs associated with a claim being made against them.
For a relatively small insurance premium, there are various policies available for individuals right through to large groups of entities to insure against the cost of future audit activity by the ATO, or any other government body (including the SRO).
